ПРАВИТЕЛЬСТВО КЫРГЫЗСКОЙ РЕСПУБЛИКИ

РАСПОРЯЖЕНИЕ

от 29 июля 2011 года № 323-р

1. Одобрить прилагаемый на государственном языке проект Грантового соглашения между Правительством Кыргызской Республики и Правительством Турецкой Республики в размере 10,0 (десять) миллионов долларов США.

2. Уполномочить министра финансов Кыргызской Республики на подписание от имени Правительства Кыргызской Республики вышеуказанного Грантового соглашения с правом внесения изменений и дополнений непринципиального характера.

GRANT AGREEMENT

dated

between the Government Republic of Turkey,

represented by the Undersecretariat of Treasury,

Prime Ministry and the Government Kyrgyz Republic

represented by the Ministry of Finance

of the Kyrgyz Republic

The Government of the Republic of Turkey hereinafter referred to as "the Donor"; and the Government of the Kyrgyz Republic hereinafter referred to as "Recipient";

Within the spirit of historical and cultural ties as well as the long existing friendly relations etween the Parties,

Desiring to strengthen and further enhance the existing friendly relations between the Parties,

Have agreed as follows:

Article 1. Amount and Purpose of the Financial Contribution

1.1. The Donor shall extend to the Recipient a financial contribution not exceeding USD 10.000000 - on a grant basis hereinafter referred to as "the Grant".

The Grant amount will be allocated to the budget financing needs.

Article 2. Disbursement

2.1. Upon the application to be made by the Recipient following the entry into force of this Agreement, 10000000 - USD of the Grant allocated to the budget financing shall be transferred by the Donor, in full or in instalments, to the account of the Recipient, details of which will be notified through diplomatic channels by the Recipient to the Donor.

The Recipient shall immediately notify the Donor through diplomatic channels of the receipt of the Grant proceeds.

The Recipient shall furnish to the Donor detailed report, after each disbursement from the Grant amount which is transferred to the Recipient's account, concerning the disbursement area(s) of the Grant.

Article 3. Costs and Public Charges

3.1. The Recipient shall bear all taxes and other public charges accruing outside the Republic of Turkey in connection with the conclusion and execution of this Agreement, as well as all transfer and conversion costs accruing in connection with the disbursements of the Grant.

Article 4. Governing Law and Settlement of Disputes

4.1. This Agreement shall be governed by the law of the Donor.

4.2. Any disputes arising between the Donor and the Recipient in connection with this Agreement shall be settled amicably.

Article 5. Notification

5.1. Any notification in writing from one of the parties to another will be deemed to have been properly communicated if it has been conveyed by hand or transmitted by cable to one of the following addresses:

Article 6. Entry into Force

6.1. The Parties shall notify each other that the national requirements for entry in force at the time of concluding this Agreement have been fulfilled. This Agreement shall enter into force on the date of the last written notification of the completion recipients and donors of internal procedures required for entry into force.

6.2. Done at _____________ on _______ /__________/ 2011 duplicates in English, Turkish and Kyrgyz languages, all three texts being authentic. The English text will be applied in case of disagreement in interpretation of the provisions of the Agreement.
